1. Acknowledgement

These Terms and Conditions ("Terms") govern your use of this website and the equipment rental services of Bahamas Machine Rentals (the "Company"). By accessing our website, requesting a quote, or entering into a rental agreement, you agree to be bound by these Terms. If you do not agree, you must not use our website or services.

2. Equipment Rental

All equipment is offered subject to availability and confirmation at the time of booking.
Rental periods, rates, and return obligations are as stated in your rental agreement or confirmed quote.
Equipment must be returned in substantially the same condition as when delivered, except for ordinary wear and tear as defined in your agreement.
The Company reserves the right to refuse or cancel any rental request at its discretion.

3. Booking & Payments

Rental requests are subject to approval by the Company; a request does not constitute a binding reservation until confirmed.
Deposits, prepayment, or security amounts may be required as set out in your agreement, invoice, or quote.
Late returns, late payments, or failure to meet payment terms may result in additional charges.

4. Use of Equipment

You agree that:

Equipment will be operated only by qualified personnel
Use will comply with all applicable laws, regulations, and manufacturer guidelines
Equipment will only be used for its intended purpose and within agreed scope
Equipment will not be subleased, reassigned, or transferred without prior written consent

5. Damage, Loss & Responsibility

You are responsible for loss, theft, or damage to the equipment during the rental period, except as otherwise agreed in writing.
The Company may charge for repair, replacement, or loss-of-use in accordance with your rental agreement.

6. Insurance

You may be required to maintain insurance coverage (including liability and property coverage) as specified in your rental agreement.
Proof of insurance may be required prior to delivery or continued use of equipment.

7. Cancellations & Refunds

Cancellation, rescheduling, and refund terms will be specified in your quote or rental agreement.
Deposits or fees may be non-refundable as stated.
Early return does not guarantee a refund unless agreed in writing.

8. Disclaimer of Warranties

All equipment and services are provided on an "as is" and "as available" basis. The Company makes no warranties, express or implied, including but not limited to:

Fitness for a particular purpose
Availability or uninterrupted use
Suitability for your specific project

9. Limitation of Liability

To the fullest extent permitted by law:

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages
The Company is not responsible for delays caused by weather, mechanical failure, supply issues, or other events beyond its control
The Company’s total liability shall not exceed the total amount paid by you for the specific rental giving rise to the claim

10. Indemnification

You agree to indemnify, defend, and hold harmless Bahamas Machine Rentals, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the equipment
Your breach of these Terms or any rental agreement
Any injury, damage, or loss occurring during your rental period

11. Force Majeure

The Company shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to weather conditions, natural disasters, mechanical breakdowns, labor disputes, or government actions.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of The Commonwealth of The Bahamas. Any disputes shall be subject to the exclusive jurisdiction of the courts of The Bahamas.

13. Entire Agreement

These Terms, together with any rental agreement, invoice, or quote, constitute the entire agreement between you and the Company and supersede all prior communications or agreements.

14. Changes to Terms

The Company may update these Terms from time to time. Updated Terms will be posted with a revised effective date. Continued use of the website or services constitutes acceptance of the updated Terms.
